Josh is ranting to the others. Matt is trying to convince him not to bring the son into it... It's not the kid's fault. Josh agrees that's true, but it's game, and she shouldn't have brought him into it. He says if he had a family weakness, he would never mention it within the walls of the house.
Josh: Anyone she's wronged. I'm gonna take it out on her.
James: No violence.
Josh: No, of course not.
James: But you can't let her bait you into it either. Just take 5 seconds off, regroup...
Josh: What's she gonna do, get Allison Grodner to talk to me?

There are people in this world who you sense are powerful just by their presence of being, then there are people who have to constantly tell or show you something to give you the impression that they are powerful.....Josh is the latter. What a discrace! So sad....

I don't think talking about someone's child is illegal. It might not be nice, but it's not illegal. Sheila is just sounding like she's scared right now. In my opinion, it would be better to ignore him. She's just giving Josh more incentive to keep it up.

Why should Josh care about what Sheila had told Matt or Ryan they are on the "other" side. Whatever she told Matt or Ryan, if they had a problem with it they could have brought it up with her. I have never posted until now. I cannot stay quiet any longer. I'm sick of J/C/J. These are the meanest, self serving and biggest hypocrit players in BB. I'm also disappointed with Ryan (he's showing his true side) he's also another hypocrite. I hope they get a token of their own medicine.
If it gets him farther in the game...oh well...they all do their own thing. It's a game and no one is themselves in that house. I think its really entertaining!!! No one is going to agree with everything everyone is doing in the house. "Hummergate" for example...not a fan.

What legal issue? I've only been a lawyer for 15 years, and clearly has been one in her mind for 45 - but she signed a waiver and truth is always a defense to defamation. Besides which, he hasn't directly said anything about the kid. Defamation required actually defaming someone, not just being a nasty prick.
I'm not saying he's a swell guy, but Sheila is a fool who held up her son like a damn lightening rod.

It's a dirty way to play, i agree, but Sheila has a point...
Lois - the very first episode (first week) Sheila told the whole world that her son had a disability. If I remember correctly, a mild form of Autism – which is quite common (though I may be wrong and please tell me if I am!). Here's my thought on that - the fact that Sheila brought it up is reprehensible. Josh has been fairly cautious not to directly discuss the disability, and only reference the vague statements Sheila made. And right or wrong, truth is a defense to defamation.
What so freaking sad is that Sheila didn't have enough brain matter to keep her son’s business to herself. I don't care if the world sends teddy bears and flowers, it's none of our business.
Once again, I'm not saying Josh is a swell guy - but anything that is said about that boy came out of Sheila's mouth first.
I want to add this though - I have no doubt that Sheila loves her son very very much. I am sure she is a good mother, and some bad judgment under these very unusual circumstances does not make her a bad person or bad mother. She was however, foolish, and very sadly her kid is going to deal with the consequences. Just in case Sheila's son is out there, we all know you got unfairly caught in this and we wish you, and your mom outside the house, only the best.

I don’t like Josh’s tactics, but he is entertaining. The house would be VERY boring if we had to listen to Sheila 24/7. I still chuckle thinking about the scene in the pool when Josh was talking to his imaginary team. No matter what anyone says, this game is hard. If you sign up to play, you need to be ready for whatever is thrown you way (if you openly talk about it in the house – its FAIR game).

This is the nature of this game. 9 players in the house at the moment and there can only be 1 winner of 1/2 a mil. second place is not to shabby either. everyone deals with stress in their own way but I am sick and tired of Sheila always trying to get a sympathy by using the single mom excuse. Everyone there can use the money and being a single mom doesnt not make you more deserving of it. I agree that Josh should not bring her son into it, but she is only to blame for that since she keeps saying "dont bring my son into it" well guess what you just provided him with your weakness and this game is a take no prisoners game. While I do think Joshua goes too far it what he says! It does make for good drama. What is bugging me the most right now is Sheila and her side (N/M) constantly calling J/S/J/C hypocrites. Yes they are! BUT they ALL are! Sheila is lying through her teeth or seriously deluding herself if she thinks she or Natalie have not talked bad about Joshuah or any other houseguest behind their back. They are all doing it! It's the name of the game. She can't trash whoever (and yes she has said some vile stuff herself) and then flip when they do it to her. I wish they would call her on it. Seriously like that group is really the "good people" that God is going to avenge. Not hardly - not any "good people" in the house. And what woman really prefers to fight pulling her and hitting - most women prefer words. Words in this context aren't typically illegal. I so hope Josh, Chelsea or Sharon wins HOH tonight! I want Sheila to finally get that she is NOT the toughest/strongest competitor in the house - totally delusional. But leave her son alone - I'm a mom too!

A ton of trivia and or flames is extremely common in the couple hours leading up to a live show.
I wouldn't read anything else into it.
Since when is talking bad about someone a legal issue. It may not be the nice thing to do but hey "C'est la vie". get over it Sheila. And even if your son is disabled to bring attention to that matter only makes it even more so. If I had a disabled kid the last thing I want is for someone to feel sorry for him or her because of their disablity. What matters are his abilities why focus on the disablity.
The one thing I don't understand about these people, do they realize they will eventually have to leave the house and go back to there normal lives.
To all the Big Brother houseguest; we are not going to care about you when the summer Big Brother starts. We will have new people to pick apart.
In the beginning, Josh was one of my favorite players! I have never really cared for Sheila in the game, and still dont. After the last few days... I cant wait for Josh to go to sequester!!! I am absolutely disgusted by his character. It is sick. I dont even want to watch/listen to him any longer.

Lawyer of 14 years - they waived their rights to sue for defamation or intentional infliction of emotional distress as to the corporation and other houseguests. And they are public figures. Besides, what are the damages? She's pissed? Maybe the kid could sue his mother - he may have a cause of action - as the majority parent she negligently waived his rights and made statements that put him, a minor who can't contract for himself, in harms way. He'd still have to prove damages. Maybe he should sue for an injunction for Sheila to shut her trap.
Josh is in the clear. Being an asshole is just not illegal.

Josh got let go from his job? That is the best news I have heard tonight. It's well deserved. I can't believe how low he has stooped this season. Remember Will? He was funny and it made the show fun to watch. To me, this is no longer a fun or interesting show to watch. Hopefully something will be done. To watch the women on the show getting bashed on after another and the men not stick up for them, is a disgrace.
Has anyone seen the contracts they sign when getting on the show? Until you have, let's not speculate.

I don't understand why she signed the waiver for a minor if she doesn't want him brought up. If she's going to be attacked, she should be attacked directly, not through her family members, who aren't there to defend themselves. Yes, she brought her son into it, but that doesn't justify Josh threatening to "rip her family apart." The threat he's making has nothing to do with game, he's just bitter and wanting some air time...so more guys will recognize him at gay bars after the show.
Newsflash Joshy, you're not "evil," you have your own flaws that can be attacked (and I don't understand why no one does!), and if this is your "game," you're going home very soon.

I know you're like me. None of these people are likable but at least give us drama or people scrambling to save themselves. None of the houseguest will be winning any Nobel Peace Prizes, so give me secret alliances, back stabbing, trash talking and eventually someone smart enough to out lie the other houseguest.

yes WILL!! He was entertaining, he caused drama, he turned people against one another, he made fun of people (I remember him going at Howie in All-Stars), and it was completely appropriate and equally entertaining as this. He never stooped to low levels, never mentioned anyone's families...kept it clean, but still entertaining.
Didn't Josh say that he wanted her to come out of the DR so that he could pull her hair out or something to that effect? Isn't that a physical threat that could get him into trouble? Just wondering?
The houseguests have talked about the waivers in their contracts for as many seasons as I have had feeds. Besides, it's not speculation that these contract prohibit liability, that's what contracts do, without those waivers everyone would be sued all the time on these shows, and all they could air is court TV.
They can waive away their civil rights (not "civil rights," rights under civil law) but not criminal rights. What that basically comes down to is they can talk as much crap as they want, but can't hit each other over the head with a frying pan, even if it happens in their favorite cartoons.

I dont think this game would be the same if everyone got along. It would be boring. BB needs to change some of the rules to stop the backdooring and them aligning on who to vote out, just because you dont want to be in the minority of the house. I'm not a lawyer of any years but I was a paralegal before retirement. I know a bit about the law.
First of all when you sign a contract of a show such as BB, you give up all rights you might have in the outside world. Plain and Simple... The end. I believe that holds true for anything except physical violence. Josh is way to smart for that and I think ths 5 foot restriction on him is WRONG. Getting in someone's face is they way to break them and it has been done on past shows and will always be as long as BB continues.
Josh is not outside the house so how can he be attacking her son to any extent that would cause legal action? And I don't think Josh would ever do that. In the house he is playing his game and playing the character that is expected of him, and I suspect prompted and pushed on him before the show and now in the DR.
We can find reason to hate or love every member of the cast in every year. We watch for entertainment and wait for them to tear each other apart as we tear them apart in comments on blogs (and this one is the best on the internet. All praise to Carolyn for reporting it fairly. We can't even tell from her blog who she loves or hates.)
I will say if Josh is evicted for this tiny attack or as a compilation of the season, it will be my last time to watch the show.. EVER.
I've always felt the show was very scripted and predetermined by Gro(d/a)ner & Gang.. Grodner or Groaner? :P) This year I have been thinking I might be wrong but if Josh is penalized for anything he has said, then I say the show is fixed. They want Sheila to win.

However, I have to sliiiightly disagree with you about Sheila: "some bad judgment under these very unusual circumstances does not make her a bad person or bad mother. She was however, foolish, and very sadly her kid is going to deal with the consequences."
I believe it was more than bad judgment. I feel she has made it quite clear from the beginning that she wanted to talk about her son (while not feeling the other HGs had a right to even mention him) and use him as a shield if anybody tried to use him in any rant against her.
She knew before coming into the house that she did not have to sign a waiver to allow her son to be mentioned at all. She signed it, knowing she wanted to use him, but evidently believing signing the waiver gave only her the right to mention him. (Isn't THAT typically Sheila.!!?!?)
She claims to not knowing what to expect when she came into the house, but has discussed (with a certain degree of knowledge) at least three other seasons. So, either (1) she knew what she was getting into when it came to family being used as psychological ammo against HGs but didn't care; or (2) if she didn't know, she didn't care enough about her "son who didn't sign up for this" to bother checking into things before agreeing to sign the waiver. (Sooooooo protective.)
As is so typical of Sheila, she wants it both ways -- she can talk, nobody else can. She can lie and manipulate others, but they better not try that on her, or she will scream "foul" and "illegal."
I, like you, want her son to know that I am truly sorry for what he *might* be going through, but the fault lies squarely in the lap of his mother. I hope he has a huge discussion with her about respecting his privacy when she gets home (which, for me, as she gets worse and worse can't be too soon).
BTW, I say *might* because I made a post in the Morning section which was about Sheila talking with Adam last night, telling Adam that she had an adult watching her son and she was sure they would know what to let him see and what not to let him see, so those HGs who thought they would get to her through making her son see them attack her were going to be hugely disappointed. (This statement sure makes it look to me like Sheila knows exactly what she is doing with her continually mentioning her son and then raising "h*ll" when someother HG does the same. Of course, Sheila doesn't play those psychological games, that is not her style.)
Anyway, you go girl. I just had a teeeeensy problem with your being so magnanimous in forgiving Sheila her "bad judgment." :)

Physical threats is a grey area. In the real world enough threats would lead to a restraining order. Only violating the restraining order would be a crime. The five foot rule seems to be BB's version of a restraining order. It really depends what the contracts say. Probably it's at the discretion of the producers. Someone did get kicked off one season for threatening a houseguest with the green plastic knife, right? I think they literally held it up to the neck and threatened to cut. Apparently that's the line - so far.

You absolutely do not have to be a lawyer to have legal mind.
Regardless of age limit common sense would tell anyone that false and misleading statements are certainly defamatory. A statement does not even have to be actually false but if it is misleading than that is a breach of law.
Truth may be an absolute defense but is does not excuse the Nature of the defendant. You must not be following closely enough. (Neither am I thank you) But what Josh has done and is attempting to do, and most certainly the NATURE and way he has gone about doing it most certainly could be proven as Slander. There are enough examples on the message boards and video clips to prove it. Get the facts straight.
You seem to be building your argument around in or out of the BB house. I am not sure how this "Waiver" thing comes into play in the BB house but certainly in real life people cannot act the way Josh has without real life repercussions, IF the plaintiff had the fortitude to see it through. If James wrote something in his Blog that would be libel. Obviously CBS knows when and where to step in when necessary.
As far as the son being a "Lightning Rod" that is just an atrocious statement. Most people who have been following this show from Week 1 know this is not the brightest group and very few if any are real thinkers. The mob rules mentality dominates this year.
I applaud Sheila for cutting trying to cut the head off of the monster before the monster got too "Technical". .I would have much rather he gave himself enough rope to hang himself Josh himself thought that was so funny earlier in the season when it came to putting down another woman to make himself feel better. From a mothers' perspective I can see why she would want to shut the boy up.
Funny how all of Joshs' "Big Moves" wind him up in the DR with a reprimand or a five foot rule. Way to go Joshy boy!!
I sure hope he (Joshy) didnt get fired. This is an extreme game that borders on social experimentation with a large money prize at the end. Besides if we all had cameras in our homes for the whole world to see, we too would be out of jobs.

As for Josh and his crew it's like watching the Nerd Herd from season 6. They were disliked for their hypocricy, not because they trash talked. Josh is the same, he does the same things he calls others out for (as does James). There's no way he's attacking Sheila for the "rest of the house." He doesn't care about them. He has some kind of emotional need to do this. He's 25 and says he's a kid. This means his emotional IQ must be lower than the average 25 year old. I hope he's ejected from the show.

Where does anyone get that he is breaking some kind of law? Dick did the same thing Josh is doing. Made fun of Amber's kids AND verbally attacked everyone. So if nothing happened to Dick then why should something happen to Josh?

I was talking strictly about the law, not morality. There are very specific things that have to result for something to be legal slander. Being very mean alone is not slander. I never said Josh was a nice person.

I can site 2 incedents off the tip of my fingers that have been similar in past seasons. Josh has done no worse than the following.
Hurricane Howie's attacks on April/Busto and her husband, job and don't forget her little dog too. (If I were on the show and talked about my dog, which is just like my child, and his handicap, then I open myself up for the same as what Busto got and what Sheila is getting.
Fireman Eric and his Sheep. (The Good People *CHOKE*) He provoked Michael into a near physical fight because he THOUGHT Michael said something about his family.
Does anyone else recall these two seasons, and maybe add more from other seasons.

Everybody is so angry with Josh already... he hasn't said anything mean about Sheila's son. I don't think he really will. He's just making her worry and that's all.

I think that is the attraction we have to this game. We want to see who does what to who. Who says what and will they deny it. Who wants it more and what will they do to get it. If we want everyone to get along then we should go back to watching the Brady Bunch.

Jane - Don't know what you have to feel guilty about. Parts is parts, facts is facts. Calling Sheila out on her chosen method of play is no worse than calling Josh out on his. Not saying you called Josh out, but plenty of others have (and from the tone of their posts, there is no guilt involved in doing so).
Everything I've read from you seems to be well-thought-out, without any unfair bias one way or another. That's what I like about your posts. I unfortunately have to say that I find way too many posters seem to have favorites and let their desires to see these people win the game fog their vision when it comes to the actions of any other player.
I really don't care who wins (as long as it isn't one of the "good people"), but I do admire the way MOST of the HGs are playing -- yes, even Josh. The kid makes me cringe every once in awhile, but he understands it is a psych-out type of game and is pretty good at "psyching 'em out" without toooo much complaining about the way he's being treated. Shebot could take a lesson or three from Josh's playbook.
"Vengance is mine," sayeth Joshua. Boy, Natalie and Sheila should be so honest. I can respect outright psychotic behavior which admits what it is. Those who act that way but claim to be "good people" are just fooling themselves and not the people they're trying to convince.
Keep up the unvarnished and unbiased commentary. It's refreshing to read.

The knife incident was in season 2. It was not a plastic knife... but a REAL bread knife that Justin held to Krista's neck jokingly saying "I am going to kill you". Both were drunk... and obviouly he didn't mean it. However, having a knife to one's throat is anything but just a threat. An accident like a slip leading to injury could really have happened. After this... no more real knives in the house.
the only penalty nomination/vote. I can think of is from last season. Jen was on slop and she ate a turkey burger because she was upset that she was on the block and BB replaced Evel Dick's cig's after she trashed them. So she basically got a vote against her when the tally of the votes came in on eviction nite. I dont know of any other time a penalty nomination or vote has come into play. Dee
OK, for people who can't take a lil "in ya face" we'll make a new show. 14 HG will be locked away in a house together. They will play Go Fish until only one HG s left. How many would like THAT show? buck up, it's a show and what Josh is/has done is just a part of it. If Sheila (and her son) are so fragile---she shoud have stayed home and let someone who can handle it play the game.

I don't know what Carolyn thinks, but that comment seems to me to come pretty close to disresepcting a poster merely because they have a different opinion than yours.
Jane has always been pretty even-handed in her comments and opinions -- at least in every post of hers that I've seen.
I truly hope you're not as angry as that post made you sound. If you are, you need to lighten up (or quit watching whatever it is that is causing such angst). It is, after all, only a game.

Both those incidents happened as you mentioned.
Every year there are moments when one person is being targeted for whatever reason. Sheila has brought it upon herself. Sure, I feel for her son... and I am glad he only watches the show. But he's practically 17, and I am sorry, at some point one has to grow a shield. After all, 'we' send kids off to war not much older than that for some real ammunition practice. I believe Sheila makes mountains out of mole hills and is a master manipulator. If she wins HoH she can get her revenge.

I believe you proved my point, which is what I was trying to get at. There ARE very specific things that have to result for something to be legal slander. And YES being very mean alone is not slander but being MISLEADING can build a case to that effect.
I did not say anything about Morality but most laws are based on some sort of moralistic standard otherwise there would be no guidelines and henceforth Anarchy. So the two go hand in hand.
Sorry but I am not in the USA or even the North/Central/South American mega continent. I do always find it interesting how people everywhere tend to put a spin on things for their own perspectives. My following BB and Carolyn's board is like peering through a social looking glass from another world which can be at times be fascinating and at other times disturbing.

Last year BB came up with Penalty noms due to breaking of House Rules. Jen got the first one in BB history for eating real food when she was on slop. But since she was already nominated she got a penalty vote against her instead. If not on the block... she would have been one of the nominees for the following week.

I don't understand how some of you can come down on James/Chelsia/Josh for being hypocrites and not Nat/Sheila/Matt.
I understand you have a rooting interest and you like you you like and hate who you hate, but BB is about hypocrisy. Everyone is playing the victim and everyone is playing the ass and everyone is playing the good person. It's nothing new and Matt is not nicer than James who is not nicer than Sheila--they are all two-faced in this game.
I get tired of reading comments saying "I hate James and Josh for being liars and I love Matt for telling it like it is" They've all lied and they've all 'told it like it is.'
That said, I'm glad Sheila's on the defensive. She thinks she runs the house when clearly she doesn't. If she or Nat don't win HoH, one can kiss the house goodbye. I think even Ryan would put both of 'em up just to save himself.

But BB is anything but a Moral Game and this is also why many of us addicts resent the people who call themselves "the good people". It happens every year. BB is a game to win $500K. It shouldn't be easy. It's a 'cut throat' game and only those strong enough should apply. Can't stand the heat... stay out of the kitchen.

It's 14-year Lawyer again. So what if Sheila waived her rights? She can't waive her son's rights. Courts only enforce those types of waivers in the recreational context.
I like that class action idea.
I am not a lawyer or psychologist, just a regular person who has 2 common sense words to explain this phenomenon: "Sheila" and "Chaos". Some people invite chaos into their lives, and Sheila is one of them by constantly talking, constantly telling everyone about herself and constantly giving everyone ammunition to use. Do you ever get the feeling that she's saying "not" to talk about her son so that everyone WILL talk about her son? It's called ATTENTION GETTING tactics. Like I said, Sheila = Chaos. For what it's worth, Josh is a Chaos lover too.... maybe they hate each other b/c they're so much alike!

14 year L - that's an interesting point. I don't know the specifics of CA law enough to have a response. It would/could be very interesting if someone someday tries to sue on that theory. If the parent can't contract away the child's rights and the child can't contract themselves, what rules apply? I would assume the producers have given this some thought - and can only guess they keep Josh in line enough so he doesn't overstep - or they both could be liable.
So far I don't think Josh has defamed the boy; Josh really hasn't said anything directly about him that isn't factual. But I suppose it could happen any minute.

I agree with your comment about "good people" vs. "bad people." I've always found the former hypocritical, sanctimonious, and, frankly, boring. The trouble is that this year the "bad people" are like caricatures. It's like the houseguests feel they have to outdo their predecessors. Josh comes off as a poor impersonation of Evel Dick. E.D.'s attacks were as mean-spirited as they come, but seemed more spontaneous and to-the-point. Josh's feel calculated (I'm not saying E.D's weren't, only that they didn't seem so) and he's a one-trick pony. This is it: Attack the next female in line by attempting to be physically imposing while spouting off tired, misogynist slurs with a campy flair. I couldn't help but root for E.D. With Josh, I find myself rooting for the subject of his tirades.
That said, I don't root for them too much. That's the problem with this year's show: No characters i love to hate. Only hate or ambivalence. I can't even muster up the energy to care much about Nat and Sheila's bible-thumping, yet I shouted at the TV when it was Amber and Jameka. Yuck!
Plus, I have to say that the "America's Choice" fiasco was the stupidest idea the producers have ever employed. Ryan had just pulled off one of the all-time BB coups, to have it undone by a bogus "twist." Looks like BB has jumped the shark.
I actually swore I wouldn't watch the show anymore after that stunt, yet I find myself frantically looking online for the latest update. I must get a life.

I thought it was so funny as soon as Josh did not get HOH he became a whiney little baby. What happened to the "I am going to make her life miserable" He certainly was wrong on who was going to get it! Also so when Chelsia watches the show back and sees how many time James throws her under the bus, I do not think there will be a relationship! He is very fast to say he does not care who they put up.. just do not put HIM up! He is a beggar to! I am super excited that the power shifted this week!
